In order to prevail, a patentee must establish that the patent-in-suit is infringed, and must also successfully defend that patent against any defense (almost certain to be raised) of invalidity and⁄or unenforceability.
To succeed, the patentee must also recover damages in an amount appreciably in excess of the costs of litigation.
The court should award to a successful patent infringement plaintiff damages sufficient to place the plaintiff in the position that the plaintiff would have occupied had the infringement not occurred.
