- Members shall provide for the protection of plant varieties either by patents or by an effective sui generis system or by any combination thereof
- Exemptions provided for farmers & breeders as protected under the Plant Varieties Protection Act have ceased to exist under the Utility Patent Act (TRIPS).
- The TRIPS Agreement is Annex 1C of the Agreement Establishing the World Trade Organization.
- 158 Members (all WTO members).
- USA is member.
